TM and DNB clash over early termination of 5G deal

In case you missed it, U Mobile has signed a three-year 5G wholesale agreement with Telekom Malaysia Berhad (TM) at the end of February. At the same time, TM confirmed and exercised its contractual rights to terminate its existing 5G wholesale access agreement with Digital Nasional Berhad (DNB). As you can imagine, this didn't sit well with DNB.

 

DNB Rejects TM’s Termination Notice Over 5G Access Agreement

With this, DNB responded to TM’s notice and public statements regarding its intention to terminate the 5G Wholesale Network Access Agreement (Access Agreement) between the two parties. The company clarified that the Access Agreement is a long-term contract, which in TM’s case runs until October 2032. The agreement includes specific provisions governing early termination.

According to DNB, TM has not exercised its right to terminate in accordance with those stipulated conditions. As such, DNB does not accept TM’s termination notice and maintains that the Access Agreement remains valid, binding, and enforceable. DNB further stated that it will take the necessary steps to protect its interests and reserves all rights available under the agreement and applicable law.

 

TM Maintains Termination Notice Is Valid

In response, TM acknowledged DNB’s media statement dated 3 March 2026 and reaffirmed its position. TM stated that it has exercised its contractual rights under the 5G Access Agreement in full compliance with the specific early termination provisions and applicable requirements.

The company explained that its decision is linked to the implementation of Malaysia’s 5G Dual Network Model, and that it was made following a thorough review of its legal rights and obligations under the agreement. TM maintains that its termination notice is valid and has reserved all its rights.

TM also noted that the Access Agreement contains dispute resolution mechanisms for addressing differences in interpretation between the parties. It confirmed that it will pursue the appropriate processes as outlined in the agreement. Despite the dispute, TM stressed that its priority remains ensuring uninterrupted service for customers while managing the transition in a phased and orderly manner.
